SERVICE CONTRACT

Subject: Home Organizing Services Agreement — ORGNZE®

Please review the terms below and confirm your acceptance to proceed with scheduling.

Services Agreement

By responding to this message with "I accept," "I agree," or any similar confirmation, you acknowledge that you have read and agree to be bound by ORGNZE®'s Home Organizing Services Agreement. This agreement covers pricing, payment terms, cancellation policy, and all other applicable terms. Our full Terms of Service are available. 

Payment Terms

ORGNZE® requires a deposit to secure your booking (see Terms of Service for deposit amount). Final payment is due upon completion of each session. Payment may be made via Thumbtack prepayment or by credit/debit card on file.

The card provided must have available funds and be in good standing at the time of charge. If a payment is declined or cannot be processed, you will have 15 days to resolve the outstanding balance. After 15 days, ORGNZE® reserves the right to pursue collection through a collections agency or other available legal remedies.

ORGNZE® handles all payment information in accordance with applicable privacy laws and industry-standard security practices.

Cancellation Policy

Cancellations made within 48 hours of a scheduled session will incur a cancellation fee of no less than two (2) hours at the agreed hourly rate, as outlined in our Terms of Service. Please review our full cancellation policy prior to booking.

Minimum Service Requirement

All bookings require a minimum of 4 hours per organizer. This applies to all sessions regardless of location or scope.

Confidentiality & Privacy

ORGNZE® maintains strict confidentiality regarding your personal belongings and information. All organizers undergo background checks prior to employment. We comply with applicable privacy laws, including the California Consumer Privacy Act (CCPA) where applicable. Our privacy policy is available upon request.

Disruption or Termination of Services

ORGNZE® reserves the right to suspend or terminate services under circumstances defined in our Terms of Service, including but not limited to unsafe conditions, misrepresentation of job scope, or conduct that threatens the safety or wellbeing of our team.

Property Damage

ORGNZE® (HardiHar LLC) takes great care throughout every session. In the unlikely event that we damage your property through our direct negligence, we are committed to repairing or replacing the item at its fair market value. Fair market value will be determined by credible valuation, taking into account current market conditions and applicable depreciation. Sentimental value is not included in this assessment. This provision does not apply to damage resulting from pre-existing conditions beyond our control.

Dispute Resolution

Any disputes arising from this agreement shall first be addressed through good-faith negotiation between both parties. If unresolved, disputes will be submitted to mediation, and if necessary, binding arbitration in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding. Nothing in this clause prevents either party from seeking emergency injunctive relief where appropriate.

Non-Solicitation

For the duration of services and for one (1) year following the conclusion of our engagement, Client agrees not to directly solicit, hire, or retain any ORGNZE® employee, contractor, or representative to perform organizing or related services outside of their engagement with ORGNZE®. This clause is intended to protect ORGNZE®'s legitimate business interests and is not intended to restrict any individual's right to seek employment.

In the event of a violation, Client agrees to pay liquidated damages equal to two times (2x) the value of services diverted, calculated at ORGNZE®'s then-current standard hourly rate, as reasonable compensation for lost revenue and business harm. Both parties agree that this amount represents a fair and reasonable estimate of damages and is not intended as a penalty.

Note: Non-compete restrictions are unenforceable in California; this clause applies solely to direct solicitation of ORGNZE® personnel by the Client.

Governing Entity

HardiHar LLC is a California Limited Liability Company authorized to conduct business in Georgia and Texas.
